Constructing Change - The Equality Act 2010 and its impact on the supply chain

The Equality Act received Royal Ascent on the 8th April this year and the main provisions under the Act will come into effect on 1st October 2010.

The Act has distilled the previous 9 Acts and over 100 statutory instruments into a single piece of all-encompassing legislation.
 
Importantly, the Act will place certain procurement specific duties on the Public Sector. These duties are:
 
  1. “to set out how procurement activity will contribute towards the achievement of your (the Public Sectors') objectives”
 
  1. “consider the use of equality related award criteria where they are relevant to the subject matter of the contract and are proportionate”
 
  1. “consider incorporating equality related contract conditions where they relate to the performance of the contract and are proportionate”
  • What will these duties really mean in practice and how will they impact on the supply chain - particularly construction?
  • What are local authorities doing now to ensure that they comply with their duties under the Act and the requirements of the Equality Framework for Local Government
  • What will businesses be expected to do to evidence their equality and diversity competencies beyond the previous and usual ‘tick-box’ exercise?
 Certain types of ‘works’ are being classified as HIGH PRIORITY 1 where equality and diversity is particularly relevant to the contract at both pre- and post-award stages.
 
“Construction / Installation” is such a contract where:
 
“work on or around residential or community buildings or public places where an awareness of the needs of disabled people, communication, religious or cultural factors is needed e.g. where contractors’ staff or sub-contracted staff will have direct regular contact with the public and/or with council staff.”
