Construction Act 2009

The Construction Act 2009 received Royal Assent on 12 November 2009 and will come into force in October 2011 and bring with it some far-reaching changes for all those involved in construction projects.

The new legislation does not just apply to construction companies - anyone engaged in a commercial construction project including clients, contractors, sub-contractors and a long list of professionals such as architects, engineers and surveyors should be aware of the changes made under the new Act. Crutes breakfast seminar will aim to cover the most salient changes in relation to:

Oral contracts
The existing legislation applies only to written contracts; however, the new Act will apply to all construction contracts, both written and oral.

Payment terms
The Act will introduce a new mechanism for dealing with interim payments. It will also clarify the content of payment and withholding notices, although it must be said that the new payment provisions are still complex.

Suspension arrangements
The new Act allows for partial suspension of work in lieu of full suspension.

Speaker profiles:

Rod Searl, head of litigation at Crutes Law Firm, partner at Crutes with over 25 years of experience dealing with litigated claims and disputes. Rod has dealt with numerous private sector construction companies, local authorities and registered social landlords defending Health and Safety prosecutions and dealing with employer liability and public liability claims.

Kevin Drysdale
, principal at Drysdales Construction Consultants, chartered quantity surveyor and project manager with over 30 years experience in the construction industry, including experience acting as an expert witness and advisor on contractual arrangements and construction disputes. Prior to establishing his own consultancy, Kevin held senior positions in market-leading construction consultancies in the UK and the Caribbean. He has also worked for major national building contractors, and benefits from having this experience on both sides of the fence.

Peter Tighe
, partner at The Geneva Group,  experienced practitioner, advisor and advocate in matters relating to UK construction and engineering projects and contractual arrangements. Pete has specific experience in drafting complex bespoke contractual arrangements in addition to Standard Forms.  Specific experience in post contract claim quantum and time extension ascertainment and/ or liabilities, post contract final account ascertainment and/ or liabilities, strategy management and delivery management experience in the resolution of UK construction and engineering project disputes in both the ADR and litigation arena.
